The Economic and International Business Law Department advises DS clients in the definition and organization of their relationships with other market participants, as well as with their national and international commercial exchanges. In this respect, DS provides all the necessary services both as to counseling and litigation.

Economic Law services concern competition, consumer and distribution law, on the one hand, and commercial law and business litigation, on the other hand. The Department has in addition special expertise in particular areas (overland transportation and logistics, waste treatment and taxation).

As far as International Business Law services are concerned, the Department advises its clients in the negotiation and drafting of international commercial agreements. Some partners/associates possess a recognized expertise in the area of indirect taxation (customs law and VAT on imports and within the EU), export subsidies (EU Common Agricultural Policy) and in the implementation of trade defense mechanisms (anti-dumping, European antidumping measures, etc.).

With regard to these overall activities, the department resolves to combine legal expertise and mastery of economic problems, providing lateral vision and understanding of the needs of each branch, takink into account daily concerns of businesses as well as the "sensitivities" of public Godies.

EUROPEAN ANTIDUMPING MEASURES

Antidumping measures represent nowadays the main commercial defense instruments designed to protect domestic production sectors threatened by illegal practices of certain exporting countries.

During times of crisis, countries usually resort to antidumping measures in order to increase their customs duty rates on specific goods exported from determined countries. This increase in duty rates allows destination countries to control the flow of goods accessing their territories.

Further to the massive delocalization wave that hit Europe, an increasing number of European enterprises exporting to the European Union are now targeted by European antidumping measures. Facing this fact, these enterprises seek highly qualified advisors in order to guide them through the complicated antidumping procedure.

On one hand, these measures represent additional costs borne by targeted enterprises when accessing the European market. On the other hand, antidumping procedures are particularly swift and complex; it is therefore highly recommended for targeted enterprises to seek technical and legal support from a law firm with a notorious customs and international trade expertise and a worldwide presence.
